Worthless Check - Checklist


The transaction MUST have taken place in Madison County
 
All checks MUST be dated less than one (1) year prior to obtaining a warrant.(We request that you obtain a warrant within 60 days of the check date when possible
 
The check writer MUST BE 18 years of age on or before the check date.
 
The Worthless Check Unit will not accept:
   a) POST DATED CHECKS
   b) TWO-PARTY CHECKS
   c) HOLD CHECKS
   d) STOP PAYMENT CHECKS
   e) LOAN CHECKS
 
You are required to send a "Statutory Notice" of returned check to the CHECK WRITER by certified mail, return receipt requested, unless on the first deposit the check is stamped:
 
   'account closed'
   'no such account'
   'no account as listed' or
   'no account found'
 
only then no letter is required.
 
 
If the letter is returned to you unsigned, NO waiting period is required.
 
 
If the receipt comes back signed, you must wait ten (10) days from the date of the signature to allow the check writer to pay before you bring the check to our office for prosecution.
